1. Introduction

Waldemar Szemat ("we", "us") operates the website szemat.pro (the "Site"). This Privacy Policy describes how we collect, use, and protect information when you visit our Site. We are committed to respecting your privacy and complying with applicable legislation, including the European Union General Data Protection Regulation (GDPR), the UK GDPR and Data Protection Act 2018, and Chile's Personal Data Protection Laws 19.628 and 21.719.

2. Data We Collect

This Site is an informational personal portfolio. We have no user accounts or profile-based tracking mechanisms. Data collection is limited to:

  • Contact form: The Site includes an optional contact form. If you choose to submit it, we collect the data you provide: your name, your email address, and the content of your message. The submission is processed through Web3Forms, a form-forwarding service operated in the United States, which delivers the message to our email. Web3Forms also records the IP address the submission is sent from and includes it in the notification we receive, as an anti-abuse measure. Apart from that IP address, we only collect the data you voluntarily enter; the form is not required to browse the Site.
  • Server technical data: Our hosting provider (Microsoft Azure) may automatically log IP addresses, browser type, and access timestamps as part of standard server logs.
  • Cloudflare (CDN and security): The Site uses Cloudflare as a content delivery network (CDN) and security provider. Cloudflare may process IP addresses, user agents, HTTP headers, and connection data to provide DDoS protection, bot management, and performance optimization.

3. Cookies and Tracking Technologies

This Site does not use web analytics, nor analytics or advertising cookies, and therefore does not display any cookie consent banner. We do not measure or profile traffic.

Cloudflare may set strictly necessary functional cookies (such as __cf_bm) for bot management and Site security. These cookies are strictly necessary for the provision of the service and are exempt from the consent requirement under applicable legislation.

To remember your language and theme (light/dark) preferences, the Site stores those values in your browser's local storage (localStorage) and, for language, also in a functional preferred-lang cookie (about one year, SameSite=Lax). These are strictly necessary for that function, do not track your activity, are not shared with third parties, and are exempt from the consent requirement.

4. Legal Basis for Processing

We process the described data under the following legal bases:

  • Pre-contractual measures (Art. 6(1)(b) GDPR): When you submit the contact form, you initiate the communication, and we process your data to respond to your request and take the preliminary steps you require.
  • Legitimate interest (Art. 6(1)(f) GDPR): For Site security and abuse prevention, to the extent that your rights and freedoms do not override it.

5. International Data Transfers

When you submit the contact form, your data (name, email, and message) is transmitted to Web3Forms, a service operated in the United States, which forwards it to our email. 6. Data Retention

Messages submitted through the contact form are kept in our email inbox for as long as necessary to handle your request and maintain a reasonable record of the communication, after which they may be deleted. Web3Forms processes the submission as email forwarding and does not require us to maintain a contacts database. Web3Forms states that it does not store form submissions on its servers: it processes them and forwards them to our email. Its server logs may contain personal data, such as the IP address, which it deletes periodically (approximately every two months). Our hosting provider's server logs are deleted according to Microsoft Azure's retention policies.

7. Your Rights

Depending on applicable legislation, you may have the following rights:

  • GDPR (EU/EEA): Right of access, rectification, erasure ("right to be forgotten"), restriction of processing, data portability, objection to processing, and not to be subject to automated decision-making.
  • UK GDPR: The same rights as the EU GDPR, applicable to UK residents under the Data Protection Act 2018.
  • Laws 19.628 and 21.719 (Chile): Right of access, rectification, cancellation, objection, and portability regarding your personal data, under the updated data protection framework.

8. Security

The Site is served over HTTPS with TLS encryption, and strict security headers (Content Security Policy, HSTS, X-Frame-Options, among others) are implemented to protect the integrity and security of your connection.

9. Third-Party Websites

The Site contains links to external platforms (LinkedIn, GitHub, Microsoft Learn, among others). We are not responsible for the privacy practices of these sites. We recommend reviewing the privacy policy of each external site you visit.

10. Children

This Site is not directed at individuals under the age of 16, and we do not intentionally collect personal data from minors.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The date of the last update is indicated at the top of this page. We recommend reviewing it regularly.
